Personal health information is not collected or stored on this website. However, Goodwill® Industries of Monocacy Valley may collect and retain such information from participants when they apply for services. Visitors to this website are not required to share personally identifiable information. Our registration, public policy action alert, volunteer orientation and donations forms require users to provide basic contact information that may include name, e-mail address, mailing address, interests and similar information. Notice of Privacy Practices

This notice describes how medical information and other private information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Federal and state laws have long provided for the data privacy of individuals receiving services from social services organizations. We adhere to state and federal privacy laws. While we are primarily a social services provider, some of the services we provide are considered “Health Care” and are subject to the Health Insurance Portability and Accountability Act (HIPAA).

This Notice of Privacy Practices describes how we may use and disclose this information and describes your rights with respect to Protected Health Information and how you can exercise those rights. Protected Health Information is individually identifiable information that relates to your past, present or future health, treatment or payment for health care services that is created or received by us in connection with the “Health Care” services we provide.

 

Types of personal information we collect

To carry out our programs, we collect and use individually identifiable information such as your name, date of birth, social security number, sex, medical history, dependent information and other personal health information. You or your referring source may provide this information on your application or other forms by phone, fax, mail, email, or other means. Policies and procedures are in place to protect your information.

Uses and disclosures of Protected Health Information (PHI)

 

We are permitted by law to use and disclose PHI for routine Treatment, Payment and Operations (TPO). By enrolling in our programs, you agree to allow us to use and disclose your Protected Health Information (PHI) for these purposes.

Treatment - We may collect or disclose your PHI, as needed, to provide the best possible services to you. Reasons why we may collect and use your PHI include sharing information with health care providers, doctors or others, as needed, to provide case management and provide coordinated services.

 

Payment - We may collect or disclose your PHI to determine eligibility for funding from a variety of funding sources, to bill for services and process claims, to ensure coordination of services, to receive payment, to respond to complaints and to complete documentation required to satisfy funding requirements needed to facilitate payment.

 

Operations – We may collect from you and use your PHI, as required, to administer, evaluate, audit and, otherwise run our programs. Examples of ways we may use your PHI include completing accreditation, certification, licensing and credentialing activities; for business planning and development; program evaluations; business management and general administrative activities; fraud and abuse detection; compliance; and other activities needed to run our business.

Our staff will use PHI, as needed, to do their jobs. We may share PHI with other providers, existing funding sources, accrediting organizations, law enforcement agencies, regulatory agencies and other organizations contracted to provide services. Agencies, organizations or individuals that we may share/receive your PHI are:

  • DDA – Developmental Disabilities Administration (for program review, evaluation and accreditation activities)
  • DORS – Department Of Rehabilitation Services (to provide and bill for services and to conduct other activities related to TPO), and other government agencies, private corporations and foundations (that fund our programs)
  • Goodwill Industries International, Inc. (for affiliate reports, national grants or other TPO)
  • Local collaborative agencies (to ensure coordination of related services)
  • People involved in your care (family member or emergency contact)
  • County attorney, attorney general or other state or federal official (in response to a court order, legal orders, subpoenas or other as requested and/ or required by law)
  • Law enforcement (to report abuse or neglect of a child or vulnerable adult, to report a serious threat to an individual’s health or safety or when a crime may have been committed).
  • Directories (We maintain a database of individuals who receive our services and staff may disclose information about your attendance and/or location for the purpose of locating you or giving you a message. Except in medical or other emergencies, we will not share this information if you request in writing that it not be shared.)
  • Public health agencies (to report public health risks) and health care providers (for coordination of services, including hospitals, if you have a medical emergency and we need to contact someone)
  • Other agencies, organizations or individuals (as allowed or required by law)

 

Your Authorization

 

For reasons other than for TPO or other related uses and disclosures outlined above, we must have your written authorization to share your PHI. Your permission may be withdrawn in writing at any time. Once we receive your written revocation of permission, we will stop using or disclosing your PHI for the purposes described in the authorization except to the extent we have already acted in reliance on your written authorization.

One example of a disclosure that requires written authorization is the use of your PHI for marketing or fundraising purposes. This includes the use of PHI in articles, brochures, grant proposals and for other related activities. Another example is the use and disclosure of PHI to employers (usually as part of work experience training, placement, supported employment and related services).

 

Your Rights

Please direct your requests to exercise rights described in this section to the Human Resources Director or Workforce Development Director at the addresses listed in the Questions and Complaints section of this Notice of Privacy Practices.

Right to request restrictions to how we use and disclose your PHI. You have the right to request, in writing, restrictions on how we use and disclose your PHI. We will notify you in writing of our decision to agree or deny your request. While we will make every effort to accommodate reasonable requests, we are not required by law to agree to a restriction.

 

Right to request confidential communications. You have the right to request, in writing, that confidential communications be provided by alternative means or at alternative locations. We will make every effort to accommodate reasonable requests.

Right to amend your PHI. You have the right to request, in writing, an amendment or correction to information contained in your Designated Record Set. The information contained in the Designated Record Set is a group of records that includes PHI used for treatment, payment or case management. We

may deny your request if the requested PHI was not created by Goodwill® Industries of Monocacy Valley, is not part of the designated record set, would not be available for inspection under the requirements for individual rights to access PHI or if the information is accurate and complete. If we deny your request, you have the right to file a statement of disagreement with the decision.

 

Right to an accounting of certain disclosures of PHI. You have the right to request, in writing, an accounting of certain disclosures of your PHI. Your request should specify the time period for which you would like to review the accounting of such disclosures. The time period may not be for longer than six years from the date of disclosure or before May 1, 2010. We are not required by law to provide an accounting of disclosures that were made to carry out TPO or where the disclosure was authorized in writing by you, made to you or a person involved in your care, made for national security or intelligence purposes or made for law enforcement situations.

Right to access PHI. You have the right to request, in writing, to access, inspect and/or get a copy of PHI that is contained in your Designated Record Set. We will notify you in writing of our decision to agree or deny your request. Access to certain PHI will be denied such as psychotherapy notes, PHI that is to be used in a civil, criminal or administrative action or proceeding, and in other situations allowed by law. We will charge you a $.05 per page fee for copies made.

Questions and Complaints

If you feel your privacy rights have been violated by Goodwill® Industries of Monocacy Valley, you may file a complaint to Goodwill® Industries of Monocacy Valley and to the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint. Complaints to Goodwill® Industries of Monocacy Valley Minnesota must be in writing and addressed to:

Effective Date and Future Changes

 

This notice is in effect May 1, 2010. We may make future changes to this Notice in order to comply with any changes to privacy laws or to make improvements to our internal privacy practices. If we make changes to the terms of this Notice, the new terms will be applicable to all PHI we have in our possession, including information that was created or received before the Notice was changed. If the Notice is changed, we will display it at our Program Services locations and post it on our website. A hard copy the Notice will also be available upon request.
